Can Foreigners Purchase Property in Thailand?
The answer is yes — however, ownership rights differ depending on the type of property and the applicable legal framework.
Condominiums
Foreign nationals may legally hold freehold title to condominium units under Thai law, subject to the foreign ownership quota and applicable legal requirements.
Houses & Villas
Foreigners generally cannot hold direct title to land. However, lawful structures such as long-term leases or property rights registration may be available depending on the circumstances.
Commercial Property
For those seeking rental income, business operations, or commercial expansion, commercial real estate in Thailand presents compelling opportunities — subject to careful structuring and legal review.
The THB 3 Million Property Investment & Long-Stay Visa
Under Thailand's Immigration Bureau framework for long-term tourism stay, a foreign national who makes a qualifying property investment of at least THB 3 million may use that investment to support an application for an annual extension of stay in the Kingdom.
Three Types of Qualifying Property Investment
(Freehold)
(Leasehold >3 yrs)
Registration
Five Qualifying Property Types
Route 1 — Purchase of Condominium (≥ THB 3 Million)
PURCHASE Key Conditions
- Property value must be at least THB 3,000,000 per unit
- Must have evidence of purchase and completed title transfer
- Used as the foreign national's personal accommodation in Thailand (Second Home)
- Endorsement and request from the Ministry of Tourism & Sports or its designated representative
- Must hold a valid Non-Immigrant visa (for extension applications)
- This right applies to the title owner only — it is personal and non-transferable
- The property cannot be subleased or used for any commercial purpose
Route 2 — Long-Term Lease (Leasehold, >3 Years)
LONG-TERM LEASE Key Conditions
- Lease agreement must exceed 3 years with total lease payments of at least THB 3,000,000 for the full term; or monthly rent of at least THB 85,000
- For annual extension: evidence of advance rent payment of at least THB 85,000/month for the full 12-month period
- Qualifying property: house / townhouse / townhome or condominium unit
- The property owner (lessor) must be a Thai natural person or Thai juristic person holding title by purchase or hire-purchase — pure lease ownership does not qualify
- The foreign national must actually reside at the property — immigration officers conduct random inspections
- Endorsement and request from the Ministry of Tourism & Sports or its designated representative
- Must hold a valid Non-Immigrant visa
- The lessee cannot sublease the property or use it for any commercial purpose
Route 3 — Property Rights Registration (ทรัพย์อิงสิทธิ์, >3 Years)
PROPERTY RIGHTS Key Conditions
- Registered property rights on land or buildings/structures on registered land (house or condo)
- Either the long-term lease consideration or the building/structure value — either one independently — must be at least THB 3,000,000
- Registration must be completed at the Land Office for a term exceeding 3 years
- Must hold a valid Non-Immigrant visa

Frequently Asked Questions
Does buying a condo worth THB 3 million automatically give me a visa?
No. The purchase is one required element, but you must also hold a valid Non-Immigrant visa, obtain an endorsement from the Ministry of Tourism & Sports or its designated representative, and satisfy all other conditions. Each application is reviewed individually.
Can I buy two cheaper condos and combine their values to reach THB 3 million?
No. The minimum value of THB 3 million must be met by a single condo unit. Combining the values of multiple units that are individually below THB 3 million does not satisfy the requirement, even if the combined total exceeds the threshold.
Can I rent out the property after using it to obtain a stay extension?
No. The property must be used as your personal residence. Subleasing or using the property for any commercial purpose is expressly prohibited. Immigration officers may conduct random inspections to verify actual residence.
Can foreigners own property in Thailand?
Yes. Foreign nationals may purchase condominium units with freehold title, subject to the foreign ownership quota. Direct land ownership is generally not permitted, though long-term leases and property rights registration are available alternatives.
Do I need a lawyer before purchasing property in Thailand?
Strongly recommended. A qualified lawyer will verify title documents, review contracts, confirm the property meets the qualifying criteria for visa purposes, and ensure the transaction is correctly structured to protect your interests.
